Following a recommendation from the CDC, the Justice Department is appealing a ruling by a federal judge in Florida that voided the transportation mask mandate extension.
“It is CDC’s continuing assessment that at this time an order requiring masking in the indoor transportation corridor remains necessary for the public health,” the CDC said in a statement reported by the CNN. “CDC will continue to monitor public health conditions to determine whether such an order remains necessary. CDC believes this is a lawful order, well within CDC’s legal authority to protect public health.”
According to the Associated Press, the notice of appeal was filed in a federal court in Tampa, Florida.
The Associated Press reports the CDC had recently extended the transportation mask mandate through May 3rd to allow more time to study the BA.2 omicron subvariant. In Florida, a federal judge struck down the transportation mask mandate, leading to major airlines and airports lifting their mask requirements.
